Terms and Conditions - Barhat VIP Subscription

1. Service definition
   Barhat VIP Subscription (the "Service") is a service offered by SC BARHAT SRL, which offers special benefits to its subscribers in exchange for a monthly fee of 49.9 lei, paid recurring by bank card.
2. Benefits
   VIP subscription customers benefit from the following advantages:
• 2 orders with free transportation each month of subscription with delivery within Romania, regardless of value (subject to the minimum order value accepted on the website);
• Barhat VIP Customer Certificate;
• Preferential prices on a selection of products established and updated by Barhat;
• Priority access to new product launches and special offers;
• Free educational materials when available;
• Exclusive VIP Customer raffle, organized every three months;
• Priority support through access to a dedicated WhatsApp communication channel.
3. VIP prices and products
   The list of products and discounts available to subscribers are determined exclusively by Barhat. The Company reserves the right to change, replace or withdraw products included in the VIP offer and their prices at any time without prior notice.
   VIP prices may be publicly visible, but only customers with an active subscription actually benefit from them at the time of placing the order.
4. Payment and invoicing
   Subscription payment is made exclusively online, by bank card, in the form of an automatic recurring payment, processed monthly.
   By activating the VIP subscription, the customer expressly agrees to the automatic monthly withdrawal of the sum of 49,9 lei from the card account used to subscribe.
   The invoice for each billing period is issued electronically and sent to the customer.
5. Subscription duration and renewal
   The VIP Subscription is valid for one calendar month from the date of payment and is automatically renewed monthly.
   Recurring payment is made until the customer decides to cancel the subscription, as described in the next section.
6. Cancellation and withdrawal
   The customer has the right to cancel the subscription at any time, directly from his customer account.
   In case of cancellation, the subscription remains active until the end of the current billing period. The amount paid is non-refundable, regardless of the time of withdrawal within the month.
7. Limitations
   VIP subscription benefits apply exclusively to orders placed on the www.barhat.ro website by the customer logged into the account associated with the active subscription.
   Benefits are not transferable and cannot be used by other accounts or persons.
8. Modification of terms
   Barhat reserves the right to modify these rules and/or the terms and conditions of the VIP program at any time.
   The updated version of the terms will be permanently available on the website, and continued use of the service after the modification constitutes the customer's acceptance of the new terms.
9. Protection of personal data
   Personal data collected for subscription activation and management is processed in accordance with Regulation (EU) 2016/679 (GDPR) and Barhat's privacy policy.
   Barhat does not store or have direct access to the card data used for recurring payment. Payments are processed securely by the authorized online payment processor.
10. Legal basis and final provisions
    This Regulation is drafted in accordance with:

• Government Ordinance No. 34/2014 on consumer rights in contracts concluded with professionals;
• Law 365/2002 on e-commerce;
• Data Protection Regulation (EU) 2016/679 (GDPR);
• Law No 193/2000 on unfair terms in contracts concluded between traders and consumers.

In the event of any inconsistency between this document and the legislation in force, the legal provisions shall prevail.

11. Subscription suspension or termination
    Barhat reserves the right to temporarily suspend or cancel a customer's subscription in the following situations:

• If recurring payment is refused by the customer's banking institution;
• if the card details used for payment are expired, invalid or withdrawn;
• in case of suspicion of misuse, fraudulent use or sharing of the VIP account with other persons;
• if actions are observed that may damage Barhat's image or interests.

In any of these cases, Barhat may suspend access to the benefits of the subscription without prior notice and will inform the client by e-mail or telephone of the reason for the suspension.
The subscription may be resumed at a later date, after the situation that caused the suspension has been remedied.
